Dear=20 Sirs;

 

RE: =20 Payment when crew is changed from a Specific Trains as provided by the = Sparwood=20 Direct Hit Coal Train Agreement.

 

This = confirms our=20 mutual understanding that a call for a =93Specific Train=94 as provided = by Article 2=20 of the Sparwood Coal Direct Hit Memorandum may be changed as herein = provided.=20

 

A crew that = has their=20 call changed from the train they were originally called to work  = will in=20 addition to the normal payment provided by the respective agreements be=20 compensated accordingly;

 

  1. A crew = called for a=20 coal train in Straight Away Service and changed to a different train = in=20 Straight Away Service will be paid a 25 mile penalty payment and in = addition=20 will be entitled to a minimum run mile claim of 134 = miles.=20

 

  1. A crew = called in=20 DHIT Straight Away Service (SAS) and changed to DHIT Turn Around = Service (TAS)=20 will be paid a 25 mile penalty  payment and will be entitled to = the 100=20 Straight Away payment as provided by the Coal DHIT Agreement from = Sparwood to=20 Cranbrook in addition to = the DH=20 payment from Cranbrook to=20 Sparwood.

 

  1. A crew = called in=20 DHIT TAS and changed to SAS will be paid the 25 mile payment and in = addition=20 will be paid the 100 mile Straight Away Deadhead payment for the = return=20 Deadhead from Sparwood to Cranbrook which they would have otherwise = been=20 entitled had their call not been changed from TAS to = SAS.=20

 

This letter = will not=20 be used to change a crew called for a train under the Coal Direct Hit = Agreement=20 to crew a train which is crewed as provided by the Crowsnest Direct Hit=20 Agreement.  These agreements will continue to be administered = separately=20 and a crew called under either agreement will continue to be limited to = work=20 defined within the respective agreement which they are originally=20 ordered.

 

Further, the = parties=20 confirm for the purposes of calculating tours of duty worked during the = 30 days=20 prior to a General Holiday crews in Direct Hit Deadhead Service will be=20 considered having completed; two tours of duty for a tour of duty in = DHIT=20 Straight Away Service and three tours of duty for a tour of duty in DHIT = Turn=20 Around Service.

 

This = memorandum will=20 be effective at 0001 the 22nd day of=20 August=20 2005 and = will remain=20 in effect until cancelled.  This Agreement may be amended as = mutually=20 agreed, or it can be cancelled by either party upon serving 30 days = written=20 notice to the other party.
